Transcription of Thomas I’s of Claines Will dated 24 August 1769(Thomas born c.1698 died 8 October 1771)
In the Name of God Amen. I, Thomas Hartwright of the Parish of Claines
in the County of Worcester Yeoman being weak in the Body But of Sound
and perfect mind and memory (thanks be given to Almighty God) do make
an ordain this my last Will and testament in the following manner (that
is to say) first and principally I commend my Soul into the Hands of
almighty God that gave it and my Body I commit to the Earth to be Buried
in a Christian manner at ye Discretion of my Executor hereafter named
and as touching the Diposition of such Worldly Estate as it hath pleased
God to bless me with in this Life I Give and Dispose thereof as followeth.
First I Give and bequeath to Elizabeth my beloved wife the sum of one
pound one shilling Exclusive of such sum or sums of Money mentioned
in certain Articles of Agreement for that purpose had and made to be
paid by my Executor in one year after my Decease. I give and bequeath
to my son Thomas Hartwright one shilling I give and bequeath to my daughter
Elizabeth Hartwright the sum of Sixty pounds and the bed, bedstead and
furniture thereunto belonging in ye best Chamber I Give and bequeath
to my daughter Mary Hartwright ye sum of forty pounds and the bed bedstead
and thereunto belonging in ye chamber over ye Pantree I give and bequeath
to my son John Hartwright ye sum of forty pounds my silver watch and
all my wearing apparel I Give and bequeath to my son George Hartwright
ye sum of forty pounds I give and bequeath to my grandson William ye
son of William Hartwright the sum of thirty pounds I Give and bequeath
to my grandson Thomas ye son of William Hartwright the sum of ten pounds
All of which the said Legacees to be paid by my Executor to each of
ye above mentioned Legatees when they shall arrive at ye age of one
and twenty years and it is my Will that if either of ye above Legatees
should dye before they arrive to ye age aforesaid or without lawfull
Issue that then his or her or their parts shall be equally Divided between
ye Survivor or Survivors of ye Children or Grandchildren of ye said
Thomas Hartwright (that is to say) that if Elizabeth Mary John or George
Hartwright or either or any of them should dye as aforesaid that then
his her or their parts to be equally Divided between the Survivors of
them likewise my Gransons the same and I Nominate and Appoint Thomas
Morris ye Younger trustee to se that this my Will be duly executed according
to the true intent and meaning and for his Trouble I Give him the sum
of one pound and one shilling and further it is my Will that If my said
Wife should Chance to Marry again that my Executor as he shall see proper
may Dispose of ye remainder part of ye Term of my Lease to be employed
towards the maintenance Clothing Education of my said Children till
each of them shall arrive at ye age above mentioned And lastly I Give
and bequeath to my Son William Hartwright ye sum of ten pounds whom
I likewise Constitute make and ordain my only and Sole Executor of this
my last Will and Testament In Witness whereof I have hereunto Sett my
Hand and Seal this 24 day of August in ye Year of our Lord 1769. Signed Sealed and published
pronounced and Declared by ye said Thomas
Hartwright as his last Will and Testament in ye presents of 24 February 1772 William Hartwright the Son sole Executor
